Welcome to RxFit (“Company”, “we”, “our”, “us”). These Terms of Service (“Terms”) govern your use of our website (rxfit.co) and your engagement with our in-home personal training and fitness services (collectively, the “Services”).
By booking a session, purchasing a package, or using our website, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.
1. Medical Disclaimer & Health Warranty
RxFit is a fitness service, not a medical provider.
- Consult Your Physician: You acknowledge that you should consult with your physician before beginning any exercise program, especially if you have a history of heart disease, high blood pressure, injury, or other medical conditions.
- No Medical Advice: While our trainers may specialize in injury recovery, corrective exercise, and functional longevity, our advice is not a substitute for professional medical diagnosis or treatment.
- Client Warranty: You represent that you are in good physical condition and have no medical reason or impairment that might prevent you from participating in active exercise. You agree to disclose any past or current injuries, surgeries, or health issues to your trainer prior to your first session.
2. Services
RxFit provides certified personal trainers who travel to your home, office, or designated location in the Austin, Texas area. Services include, but are not limited to:
- In-home personal training.
- Semi-private training.
- Nutrition coaching and meal prep guidance.
- Functional movement assessments.
Service Area: We primarily serve East, North, West, and South Austin. We reserve the right to decline services to locations outside our feasible travel radius or to charge a travel fee for such locations (agreed upon in advance).
3. Scheduling and Cancellation Policy
We respect your time and the time of our trainers. To ensure efficient scheduling, we enforce the following policy:
- 24-Hour Notice: You must provide at least 24 hours’ notice to cancel or reschedule a session.
- Late Cancellation/No-Show: If you cancel with less than 24 hours’ notice or fail to be present at the scheduled location within 15 minutes of the start time, you will be charged the full cost of the session (or one session will be deducted from your package).
- Trainer Cancellation: In the rare event that an RxFit trainer must cancel within 24 hours, we will reschedule your session at the earliest convenience, and you will not be penalized.
4. Client Responsibilities (In-Home Environment)
Because we operate in your personal space, you agree to maintain a safe and professional environment:
- Safe Space: You must provide a clear, safe area suitable for exercise (approx. 6×6 feet minimum), free of hazards.
- Pets: For the safety of both the trainer and the animal, please ensure pets are secured or in a separate room during the session unless otherwise agreed upon.
- Conduct: We maintain a zero-tolerance policy for harassment, inappropriate behavior, or unsafe conduct. RxFit trainers reserve the right to terminate a session immediately if they feel unsafe or uncomfortable. In such cases, no refund will be issued.
5. Payments and Refunds
- Payment: Payment is due prior to the delivery of services. We accept major credit cards and electronic transfers.
- Auto-Renewal: If you subscribe to a recurring membership or monthly program, your payment method will be charged automatically on the billing cycle date.
- Refunds: All sales of personal training packages and nutrition plans are final. Unused sessions may be transferable to a family member at RxFit’s sole discretion but are non-refundable.
6. Assumption of Risk and Liability Waiver
By participating in RxFit services, you voluntarily assume all risks associated with physical exercise, including but not limited to injury, strain, or cardiovascular events.
- Release: You hereby release, indemnify, and hold harmless RxFit, its owners, employees, and contractors from any claims, demands, or causes of action arising out of your participation in our training programs, except in cases of proven gross negligence by RxFit.
- Property Damage: RxFit is not liable for any damage to your personal property (e.g., furniture, flooring) that may occur during the normal course of in-home training.
7. Intellectual Property
All content provided by RxFit, including workout plans, nutritional guides, and the RxFit logo, is the intellectual property of RxFit. You are granted a limited license to use these materials for your personal fitness journey only. You may not reproduce or resell our programming.
8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas. Any disputes arising from these Terms or the Services shall be resolved in the courts located in Travis County, Texas.
